Terms of Use

Agreement to these terms

These terms govern your use of the Smoke Shop Kart website (the “Website”) and your purchases at our four Central Florida shops. By using the Website or buying from a shop, you agree to them. If you do not agree, please do not use the Website. Our Privacy Policy describes how we handle information and is part of these terms.

You must be 21 or older

Everything we sell is restricted to adults 21 years of age and older under Florida and federal law, and the Website is intended for the same audience.

  • A valid government-issued photo ID is required for every purchase, every time, with no exceptions;
  • We refuse any sale where age cannot be verified, and we may refuse service to anyone we reasonably believe is buying on behalf of a person under 21;
  • Delivery orders are age-verified again at the door by our delivery partner before hand-off.

An informational website; sales happen in store

The Website is a catalog of what our shops carry, not an online store: there is no checkout here, and listing a product is not an offer to sell it. Stock rotates by shop and by week, so availability, flavors and prices shown on the Website can differ from the shelf, and the shelf controls. If a price is misprinted here, the in-store price applies.

Delivery through a third party

When available, delivery is provided through our delivery partner, Saucey, an independent service. When you order delivery, you contract with that service under its own terms, prices and policies, including its identity and age verification at hand-off. We are not responsible for the delivery service’s acts, omissions or delivery times.

Products, labels and lawful use

  • Product information on the Website is general and descriptive. The manufacturer’s label and directions on the product you buy always control, and you agree to read and follow them;
  • We make no health, wellness, effect or medical claims about any product, and nothing on the Website is medical advice;
  • Hemp-derived cannabinoid, kratom and amanita product laws vary by state and change over time. We stock what is lawful to sell in Florida at the time we stock it, and you are responsible for using and transporting products lawfully where you are;
  • Glassware and accessories are sold for use with lawful products only;
  • Nicotine warning: many products we sell contain nicotine, which is an addictive chemical.

Returns and exchanges

Returns and exchanges are handled at the counter of the shop where you bought the item; bring the item and your receipt, and ask the crew before opening a product if you are unsure. Where a manufacturer covers defects, we will help you use that coverage. Some categories cannot lawfully or safely be resold once sold, and returns on them may be limited to defects.

Website content and intellectual property

The Website’s content, design and text belong to Smoke Shop Kart and may not be copied for commercial use without our permission. Brand names, product names and logos shown on the Website belong to their respective owners and appear only to identify the genuine products we stock; no affiliation or endorsement is implied.

Reviews and third-party content

Customer reviews shown on the Website are real reviews posted publicly on Google, reproduced word for word and attributed to their authors. They reflect those customers’ own experiences and opinions, not statements by us. Links to third-party sites are provided for convenience, and we are not responsible for their content.

Disclaimer of warranties

The Website is provided “as is” and “as available,” without warranties of any kind, express or implied, including accuracy, availability and fitness for a particular purpose. Products are covered only by their manufacturers’ warranties, where one exists.

Limitation of liability

To the fullest extent permitted by law, Smoke Shop Kart and its owners and employees are not liable for indirect, incidental, consequential or punitive damages arising from your use of the Website or of any product, and our total liability for any claim is limited to the amount you paid for the product giving rise to it. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Governing law

These terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules, and any dispute will be brought in the state or federal courts located in Florida.

Changes to these terms

We may update these terms from time to time. The current version will always be posted here with its effective date, and continued use of the Website after a change means you accept the updated terms.
